Is Jawaharlal Nehru known as the father of the Indian Constitution?

PM Nehru and subsequent dynastic congress leaders amended the constitution nearly 80 times. This way Jawaharlal Nehru can be said as the father of Indian Constitution.

In almost all election rallies, congress leader RaGa creates environment of fear mongering that the BJP will change the constitution if it comes to power for third term. But same RaGa says ‘We will change the constitution to remove the 50% limit on reservations’ and ‘we will change the constitution to redistribute reservation for OBC, SC, and ST to one particular community which is congress’s core vote bank’ and ‘we will change the constitution to bring all peacefuls into the OBC’.

Congress leader RaGa multiple times advocated for wealth to be redistributed as per the proportion of various sections in India’s population while speaking to people at a Nyay Manch events. BJP is useing this as more ammunition to attack the Wayanad MP and his party amid the Lok Sabha polls, questioning the communist economic model that he is promising and is a clear intention to change the constitution.

Congress supporters along with leftist, communist, librandµs are not crying foul that congress will again change constitution if they comes to power. These librandµs are crying foul that if Modi government gets more than 400 Lok Sabha seats, they will change the constitution. Although PM Modi is denying any chance of constitutional change but they dislike and distrust Modi/BJP so much that they will never get convinced.

This means if congress changes the constitution, it is ok because they have divine right to do so as they belong to Nehru-Gandhi dynasty. BJP being a fascist party, has no right to change the constitution as per them.

The Minister of Road Transport and Highways Nitin Gadkari on 10 May 2024 said the opposition parties were confusing people by claiming that the BJP would change the Constitution if it retains power, but it was the congress party that had amended the Constitution 80 times during its regime. He also alleged that people remained poor in this country because of the wrong economic policies of the congress. Gadkari was addressing an election rally at Majalgaon town in Beed district to drum up support for BJP candidate Pankaja Munde.

Our opposition has failed to convince people on their development model. Therefore it is confusing them. They (opposition leaders) say we (BJP) will change the constitution. But there is a Supreme Court judgment that says the Constitution cannot be changed and only amendments can be made. We will not stop and continue our work till the last poor person is benefited. We worked for 10 years, but despite being in power for 60 years, the congress did not do anything. So now, when they cannot contest elections by projecting their work, they are trying to confuse people, Gadkari said.

Gadkari urged the electorate not to vote on the basis of caste or religion in the election. Do we think about the doctor's caste when we undergo a heart surgery? Gadkari said he had big plans for sugar factories to get license for setting up ethanol pump for selling new age fuel for vehicles. Now, farmers will not only be energy producers, but they will also produce aviation fuel and bio-bitumen out of agricultural waste. This man is a visionary which India needs. Gadkari do not talk communal and divisive issues. He do not attack political rivals with abusive languages. Yet, he criticised congress for repeated amendments to the constitution to its own benefit from time to time. This shows congress lacks visionary leader like Nitin Gadkari but have only appeasement policy and fear mongering to get votes.

How the constitutional changes started? The Indian constitution became effective from 26 January 1950. In 1951, a year later first constitution change was made by PM Nehru government where laws passed by parliament under Ninth Schedule cannot be struck down by High Court or Supreme Court (Article 31B). Journalist Romesh Thapar once dared to criticise the Nehru in his journal named ‘Cross roads’ in 1950. Jawaharlal Nehru autocratically banned the journal and sent author in Arthur road Jail. Romesh Thapar went to Supreme Court and Nehru lost the case on 26th May, 1950. Nehru amended the constitution and added 19(2) against freedom of speech and again banned the journal.

Moral of the story – Nehru was great visionary leader and Modi is a dictator. Only dynastic congress leaders have the divine right to change the constitution. Indira Gandhi made major change to constitution during emergency era when most opposition leaders were in jails.
